存疑时有利于被告原则是体现我国刑事诉讼法保障人权与惩罚犯罪相统一的一项原则，是对古代法思想所包含的“民本”思想的演变与发展，其以保障人权、控辩双方平等武装进行审判的公平游戏以及国家提出的相关政策作为理论依据；其与相关刑事原则存在一定的联系但是又有所区别，不当的适用扩大了该原则的适用范围。此外，作为保障犯罪人权的一项原则，其应平衡被害人基本权益与被告人基本人权，不得不当扩大其适用范围，应对其适用范围加以合理限制。
