婚礼现场布置的著作权问题研究

随着婚庆行业的迅速发展，定制婚礼现场布置逐步成为主流。当前，因抄袭、盗用婚礼现场布置所引发的侵权争议越来越常见，然而婚礼现场布置是否属于《著作权法》列举的作品类型，能否纳入著作权的保护范围，在现行《著作权法》中无法找到现成答案，法院在法律适用上也是困难重重。因此，本文通过引入婚礼现场布置侵权案，论证得出婚礼现场布置应当属于视听作品或其他智力成果的结论，并进行相应的侵权判断，从而提出有关婚礼现场布置的著作权侵权风险规避策略，即：确保存在文字作品或图形作品、通过合同约定权利归属、提高知识产权意识三个方面，以促使更多高质量作品的产生与传播。
With the rapid development of the wedding industry, customized wedding scene layout has gradually become the mainstream. At present, the infringement disputes caused by plagiarism and embezzlement of wedding scene layout are more and more common. However, whether wedding scene layout belongs to the types of works listed in the Copyright Law and whether it can be included in the scope of copyright protection cannot be found in the current Copyright Law, and the court is also difficult to apply the law. Therefore, by introducing the infringement case of wedding scene layout, this paper demonstrates the conclusion that wedding scene layout should belong to audiovisual works or other intellectual achievements, and makes corresponding infringement judgments, so as to propose copyright infringement risk avoidance strategies related to wedding scene layout, namely: Ensuring the existence of written or graphic works, agreeing on the ownership of rights through contracts, and raising awareness of intellectual property rights are three aspects to promote the production and dissemination of more high-quality works.
