目的解释方法之“目的”辨析

目的解释在法律解释体系中占据重要地位。在法律适用过程中，目的解释方法成为打破司法僵局，使法律与复杂多变的社会关系相适应的关键所在。然而目的解释方法在法解释实践中所探求的法律目的有诸多分歧，包括主观目的与客观目的、法律整体目的与法条个别目的之间的分歧。对此本文通过理论法学与中国本土法律环境相结合，具体解决目的解释方法的“目的”分歧，应当坚持主观与客观的融合发展、坚持整体目的与个别目的之间的互动循环，推动我国目的解释方法适用的实践进程。
Purpose interpretation occupies an important position in the legal interpretation system. In the process of applying law, the method of purpose interpretation has become the key to breaking the judicial deadlock and adapting the law to complex and changeable social relations. However, there are many differences between the legal purpose explored in the practice of legal interpretation, including the difference between subjective purpose and objective purpose, the overall purpose of law and the individual purpose of legal provisions. In this regard, this paper combines theoretical jurisprudence with China’s local legal environment to specifically solve the “purpose” differences between purpose interpretation methods, and should adhere to the integrated development of subjectivity and objectivity, adhere to the interactive cycle between overall purpose and individual purposes, and promote the practical process of the application of purpose interpretation methods in China.
