陕西生态环境保护创制性立法研究
Research on the Creative Legislation of Ecological Environment Protection in Shaanxi Province

地方立法是地方治理的法治基石，党的二十大报告指出中国式现代化是人与自然和谐共生的现代化，2015年《中华人民共和国立法法》赋予地方国家权力机关生态环境保护立法权限。陕西省现行有效的生态环境保护制度较为全面，但存在区域协同立法机制不健全、可操作性不强、规定缺乏针对性、公众参与程度不高等问题。整体协同立法建立区域生态补偿机制、增强立法可操作性、推动地方立法精细化、落实公众参与立法制度是推动地方生态环境保护创制性立法的有效途径。
Local legislation is the cornerstone of the rule of law in local governance. The Party’s 20th annual report pointed out that Chinese-style modernization is the modernization of harmonious coexistence between man and nature. The 2015 legislative law of the People’s Republic of China gives local state authorities the power to legislate on ecological and environmental protection. The current effective ecological and environmental protection system in Shaanxi Province is relatively comprehensive, but there are problems such as imperfect regional coordination legislation mechanism, weak operability, lack of coarse regulation and pertinence, and low degree of public participation. The effective way to promote local ecological and environmental protection creative legislation is to establish a regional ecological compensation mechanism through overall coordinated legislation, enhance the legislative operability, promote the refinement of local legislation, and to implement the legislative system of public participation.
