公益诉讼检察在北京市市域社会治理中作用研究
Research on the Role of Public Interest Litigation in the Social Governance of the Capital City

公益诉讼检察是新的制度尝试和创新，公益诉讼检察在首都市域内的推行有示范和引领作用。本文旨在明确公益诉讼检察的内涵及司法和实际定位，总结公益诉讼检察在首都市域内试行和推进的成果，结合相关案例和实践，用案例结合嵌入的方式分析公益诉讼检察在北京市市域社会治理的作用，讨论了在党的领导下我国的公益诉讼检察的制度优势，以及现行公益诉讼检察制度的不足。最后，笔者结合实践经验，提出了对公益诉讼检察制度发展的建议。
Public interest litigation is a new institutional attempt and innovation. The implementation of public interest litigation in the capital city has an exemplary and leading role. This paper aims to clarify the connotation and judicial and practical positioning of public interest litigation, summarize the results of the trial and promotion of public interest litigation in the capital city, combine relevant cases and practices, analyze the social governance role of public interest litigation in the capital city by combining cases with embedded methods, and discuss the advantages of China’s public interest litigation system under the leadership of the Party, as well as the shortcomings of the current public interest litigation system. Finally, the author puts forward some suggestions on the development of the prosecutorial system of public interest litigation based on practical experience.
