海上钻井平台与船舶存在客观上的差异,不宜将两者等同。在法律属性的界定上,应保持海上钻井平台的独立性,以避免相关争议的继续并引发其他事项争议。但在海洋油污损害赔偿范围内,将海上钻井平台油污损害赔偿法律问题参照船舶油污损害处理,在我国具有现实必要性与可行性
