%X this article explains the context and the importance of one of the most important rulings emitted by the german federal constitutional court, emphasizing the "irradiation effect" as expression of a culture that gives prevalence to fundamental rights over other legal aspects. additionally it refers to the distinction among principles and rules which enable the construction of certain methods of interpretation.
