%X 部分消费者滥用“仅退款”规则已危害到商家与平台的合法权益,而最终责任将转由全部消费者承担,最终沦为“三方皆输”局面。应当坚持以《消保法》与《民法典》为指导依据,推进“仅退款”条款的适用情形分级管理,并明确平台、消费者、商家的权利义务,以促进“三方共赢”局面的形成。
The abuse of the “refund only” rule by some consumers has endangered the legitimate rights and interests of merchants and platforms, and the ultimate responsibility will be borne by all consumers, ultimately leading to a situation where all three parties lose. We should adhere to the guidance of the Consumer Protection Law and the Civil Code, promote the hierarchical management of the application of the “refund only” clause, and clarify the rights and obligations of platforms, consumers, and merchants to promote the formation of a “win-win” situation.
