%X 数字经济背景下，信息技术的发展推动了互联网平台的繁荣，也导致了呈现新样态的滥用市场支配地位行为，当下在对其进行规制时，面临着相关市场界定存在困难、支配地位判断缺乏标准以及滥用行为认定陷入困境的三重维度障碍。对此，应当根据互联网平台的特性完善相关市场的界定制度，运用多因素判断法进行需求替代分析，并在双边市场的逻辑下优化垄断者测试分析方法；同时，细化并明确判断市场支配地位的标准，结合多重因素进行考量；最后，通过明确平台主体责任、综合判断主观目的、建立多元审查机制以及界定平台属性等方式构建完善的规则体系以准确认定滥用市场支配地位的行为，推动我国互联网平台经济的发展行稳致远。
In the context of the digital economy, the development of information technology has promoted the prosperity of the Internet platform, and has also led to a new pattern of abuse of market dominance. At present, when regulating it, it is faced with three dimensional obstacles: difficulties in defining the relevant market, lack of standards for judging the dominant position, and difficulties in identifying abuse. In this regard, we should improve the definition system of the relevant market according to the characteristics of the Internet platform, use the multi factor judgment method to conduct demand substitution analysis, and optimize the monopolist test analysis method under the logic of the bilateral market, at the same time, refine and clarify the criteria for determining market dominance, taking into account multiple factors; Finally, by clarifying the responsibility of the platform subject, comprehensively judging the subjective purpose, establishing a diversified review mechanism, and defining the attributes of the platform, we can build a sound rule system to accurately identify the behavior of abusing market dominance, and promote the development of China’s Internet platform economy.
