%X 外资安全审查制度期望实现保障国家安全与促进外商投资共同成为外商投资法的二元目标，这体现于2020年施行的《外商投资法》，既明确对外资实行准入前国民待遇加负面清单管理制度是着眼于吸引外商投资的重要举措，也明确保障国家安全的重要价值。现阶段因国际经济形势，二元目标间的内在张力使得日趋严格的外资安全审查措施与逐步丰富的促进和便利投资内容同样成为需要审慎酌定的事项，于是，完善外资安全审查制度的二元目标，需立足负面清单制度衔接优化，贯彻总体国家安全观核心理念，构建开放与安全动态平衡的治理框架。
The foreign investment security review system aims to achieve the dual goals of safeguarding national security and promoting foreign investment. This is reflected in the implementation of the Foreign Investment Law in 2020, which not only clarifies that the implementation of the pre admission national treatment and negative list management system for foreign investment is an important measure to attract foreign investment, but also clarifies the important value of safeguarding national security. At present, in response to the international economic situation, the inherent tension between the dual goals has made increasingly strict foreign investment security review measures and gradually enriched investment promotion and facilitation content equally a matter that requires careful consideration. Therefore, the improvement of the foreign investment security review system under the dual goals needs to adhere to the fundamental values such as the overall national security concept on the basis of handling the connection with the negative list management system.
