%X 近年来,互联网行业中电子商务平台的迅猛发展对竞争立法、执法和司法提出了诸多问题。其中,比较典型的是滥用相对优势地位的规制问题。《反垄断法》仅规定禁止滥用市场支配地位的行为,却未明确提出相对优势地位的概念;《反不正当竞争法(修订草案送审稿)》将滥用相对优势地位纳入规制范围;《中华人民共和国电子商务法》在明确提出相对优势地位的基础上,要求电子商务平台不得进行不合理限制。这些法律法规都没有系统且详实地明确滥用相对优势地位的概念、法律关系以及法律后果。为更好地规范电子商务竞争秩序、维护市场经济健康发展,文章通过比较研究国内外电子商务平台之间的“二选一”行为,结合滥用相对优势地位的行为性质和我国竞争法体系的现状,提出将滥用相对优势地位行为纳入我国竞争法体系,对其造成的损害予以多元法律规制,最终实现维护消费者合法权益和促进电子商务平台的和谐有序发展。
In recent years, the rapid development of e-commerce platforms in the internet industry has put forward many problems for competition legislation, law enforcement, and justice. Among them, the more typical problem is the regulation of the abuse of comparative advantage position. The “Anti-Monopoly Law” only forbids the abuse of the dominant market position but does not specify the concept of comparative dominant position; the “Anti-Unfair Competition Law (Revised Draft for Review)” includes the abuse of comparative dominant position; the “E-Commerce Law of the People’s Republic of China”, on the basis of the explicit comparative dominant position, requires the e-commerce platform not to impose unreasonable restrictions. None of these laws and regulations systematically and in detail clarify the concept of abuse, legal relations, and legal consequences of the abuse of comparative advantage. To better standardize the order of e-commerce competition and maintain the healthy development of the market economy, this paper, through the comparative study between the “alternative e-commerce platform” behavior, combined with the abuse of comparative advantage behavior and the present situation of competition law system in China, put forward the abuse of comparative advantage behavior into our competition law system, the damage to multiple legal regulations, finally safeguard the legitimate rights and interests of consumers and promote the harmonious and orderly development of e-commerce platform.
