Research on the Occupational Injury Protection for Flexible Employees in New Business Forms—Taking Online Ride-Hailing Drivers as an Example %A 陈玙婕 %J Modern Management %P 265-269 %@ 2160-732X %D 2025 %I Hans Publishing %R 10.12677/mm.2025.154110 %X 信息技术与数字经济的迅猛发展推动了新业态平台经济的发展,产生了大量的工作机会,有效推动了就业率的提升。然而交通事故、过劳死等职业伤害风险也给灵活就业人员带来严重的威胁,从事这些平台工作的就业人员在工作中受到伤害的情况难以得到相应的救济与保障。本文以网约车司机为例,对其进行抽样调查与访谈,揭示其传统的劳动关系认定标准滞后、工伤认定程序繁琐、商业性人身意外保障作用有限等职业伤害保障的现实困境,并提出相应解决措施的对策建议。
The rapid development of information technology and the digital economy has promoted the development of the platform economy in new business forms, creating a large number of job opportunities and effectively boosting the employment rate. However, occupational injury risks such as traffic accidents and death from overwork also pose a serious threat to flexible employees. It is difficult for employees engaged in platform work to receive corresponding relief and protection when they are injured at work. Taking online ride-hailing drivers as an example, this paper conducts a sampling survey and interviews to reveal the practical dilemmas of their occupational injury protection, such as the lagging recognition standards of traditional labor relations, the cumbersome work-related injury identification procedures, and the limited role of commercial personal accident insurance.
