%X 伴随着平台经济快速发展,电商领域知识产权治理的复杂性日益凸显。传统治理模式面临着双重困境:政府主导的行政规制因运动式执法导致效果不稳定,且知识产权维权援助机构法律属性不明;企业自我规制则因平台治理者正当性与中立性受质疑而存在缺陷。二者共同导致电商平台知识产权侵权行为常态化,对消费者权益与市场秩序造成双重冲击。基于此,有必要借鉴公私合作的治理模式,探索构建“政府–平台”双核心协同治理框架,该框架以常态化政企协作为基础,结合智能化侵权识别技术,区块链证据存证以及多方监督机制,通过强化,整合政府、平台、第三方机构及消费者资源,形成全链条保护格局,助力电商经济规范有序发展。
With the rapid development of the platform economy, the complexity of intellectual property governance in the e-commerce sector has become increasingly prominent. Traditional governance models face dual dilemmas: government-led administrative regulation suffers from unstable effectiveness due to campaign-style enforcement, while intellectual property rights assistance institutions lack clear legal definitions. Meanwhile, corporate self-regulation is flawed as the legitimacy and neutrality of platform governance entities are questioned. These issues collectively lead to the normalization of intellectual property infringements on e-commerce platforms, posing dual threats to consumer rights and market order. To address this, it is imperative to learn from the governance model of public-private cooperation and explore the construction of a “government-platform” dual-core collaborative governance framework. The framework is based on normal government-enterprise cooperation, combined with intelligent infringement identification technology, blockchain evidence storage and multi-party supervision mechanism, through strengthening, integrating government, platform, third-party institutions and consumer resources, forming a full-chain protection pattern, and helping the standardized and orderly development of the e-commerce economy.
