Research on the Applicability of the Unconditional Return System for Consumers in E-Commerce Transactions %A 郑宇畅 %J E-Commerce Letters %P 1083-1089 %@ 2168-5851 %D 2025 %I Hans Publishing %R 10.12677/ecl.2025.144988 %X 本文深入研究了电商交易中消费者“七日无理由退货”制度的适用现状及其存在的问题。随着电子商务的迅猛发展,消费者在远程交易中面临信息不对称等风险,“无理由退货”制度应运而生,成为平衡消费者与经营者利益的重要机制。然而,当前制度在实践中暴露出诸多问题,如适用范围模糊、商品“完好”标准难以衡量、消费者权利滥用等。通过对现行法律法规、司法实践现状的分析,本文提出了细化不宜退货商品清单、完善商品“完好”认定标准以及规制消费者恶意行为等完善建议。研究旨在为优化电商交易环境、保障消费者权益提供理论支持和实践指导,推动电子商务行业的健康、可持续发展。
This paper conducts an in-depth investigation into the application status and existing issues of the “seven-day no-questions-asked return policy” in e-commerce transactions. With the rapid development of electronic commerce, consumers face risks such as information asymmetry in remote transactions, which prompted the emergence of this return policy as a crucial mechanism to balance interests between consumers and business operators. However, current implementation reveals multiple challenges, including ambiguous scope of application, difficulties in quantifying the “intact condition” of returned goods, and misuse of consumer rights. Through analysis of current legal regulations and judicial practices, this study proposes improvement strategies such as refining the list of non-returnable products, establishing clearer standards for assessing product integrity, and regulating malicious consumer behaviors. The research aims to provide theoretical support and practical guidance for optimizing e-commerce transaction environments, protecting consumer rights, and promoting healthy and sustainable development within the e-commerce industry. %K 无理由退货, %K 消费者权益保护, %K 商品完好, %K 适用范围
