Legal Regulation of Algorithmic Discrimination on E-Commerce Platforms in the Era of Big Data %A 陈泽原 %J E-Commerce Letters %P 790-796 %@ 2168-5851 %D 2025 %I Hans Publishing %R 10.12677/ecl.2025.144952 %X 随着大数据时代的来临,电商平台算法歧视主要表现为价格歧视、性别歧视及信息茧房,其技术根源在于数据偏见累积与算法黑箱特性,不仅侵犯消费者公平交易权与知情权,还加剧市场秩序混乱与群体不平等。同时,法律存在立法滞后、举证困难以及跨境监管等困境,难以解决实际问题。只有构建“技术治理 + 制度创新 + 社会共治”的三维框架,依靠立法完善、建立数据清洁度评估机制、建立算法开发者与数据提供方承担连带责任以及提高公民算法素养教育等多维度措施,可以系统性破解算法歧视的现实难题,平衡技术发展和公平正义。
With the advent of the big data era, algorithmic discrimination on e-commerce platforms mainly manifests itself in price discrimination, gender discrimination and information cocoon, whose technical roots lie in the accumulation of data bias and the black-box characteristics of algorithms, which not only infringes on consumers’ right to fair trade and right to know, but also exacerbates the chaos of the market order and inequality in the group. At the same time, the law is lagging behind, difficult to prove and cross-border regulation, which makes it difficult to solve the practical problems. Only by building a three-dimensional framework of “technical governance + institutional innovation + social co-management”, relying on multi-dimensional measures such as improving legislation, establishing a data cleanliness assessment mechanism, establishing joint and several liabilities for algorithm developers and data providers, and improving citizens’ education on algorithm literacy, can the real problem of algorithmic discrimination be solved systematically, balancing technological development and fairness and justice. %K 电商平台, %K 算法歧视, %K 法律规制
