%X 基于劳动关系的从属性,劳动者隐私权与雇主的监督管理权之间存在冲突,使得劳动者隐私权保护存在特殊之处。进入数字社会,信息技术和数字技术变革了劳动者的工作环境,一方面,使得生产效率大大提高,另一方面,也在更大范围内和更深层次上存在侵害劳动者隐私权的可能。当前我国立法中关于劳动者隐私权保护的相关规范仍有值得改进之处,应当完善劳动法立法,在劳动法中增加劳动者隐私权保护的基本原则,以使其与隐私权保护的一般规则形成良好的衔接。其次,应当分场所实行不同的劳动者隐私权保护模式、拓展劳动者隐私权保护内容、在企业内部建立隐私保护机制,以更好面对新技术的挑战。
Due to the subordinate nature of labor relations, there is a conflict between the privacy rights of workers and the supervisory and managerial rights of employers, which creates unique challenges in protecting workers’ privacy. In the digital society, information technology has transformed the working environment of laborers. On the one hand, it has significantly improved production efficiency; on the other hand, it has also increased the potential for infringements on workers’ privacy rights on a broader scale and at a deeper level. Currently, there is still room for improvement in China’s legislation regarding the protection of workers’ privacy rights. It is necessary to improve labor law legislation by incorporating fundamental principles for the protection of workers’ privacy rights into the labor law, ensuring a seamless connection with the general rules of privacy protection. Furthermore, different privacy protection models should be implemented based on specific workplace settings, the scope of workers’ privacy rights should be expanded, and internal privacy protection mechanisms should be established within enterprises to better address the challenges posed by new technologies.
