%X 本文旨在深入探讨我国个人破产准入制度的构建问题，文章首先阐述了个人破产准入制度的理论意义和现实意义，指出其是建立个人破产制度的前提，对适格主体和破产标准的研究有助于丰富学界对个人破产制度的探索，促进我国破产法律体系的发展与完备。同时，借鉴美国、日本等发达国家的个人破产制度经验，提出我国个人破产准入制度应采用一般主义原则，将所有类型的自然人纳入主体范围，并细化破产原因的判断标准，确保制度设计的公平性和可操作性。文章最后提出建立健全我国个人破产准入制度的建议，通过本文的研究，期望为我国个人破产制度的构建提供理论依据和实践指导，推动我国破产法律体系的进一步完善。
The purpose of this paper is to deeply discuss the construction of personal bankruptcy access system in China. This paper first expounds the theoretical and practical significance of the personal bankruptcy access system, and points out that it is the premise of establishing the personal bankruptcy system. The research on the eligible subject and the bankruptcy standard is helpful to enrich the academic circle’s exploration of the personal bankruptcy system, and promote the development and perfection of the bankruptcy legal system in China. At the same time, drawing on the experience of the personal bankruptcy system in developed countries such as the United States and Japan, this paper puts forward that China’s personal bankruptcy access system should adopt the principle of generalism, include all types of natural persons into the scope of the subject, and specify the criteria for judging the cause of bankruptcy, so as to ensure the fairness and operability of the system design. At last, the article puts forward the suggestion of establishing and improving the personal bankruptcy access system of our country. Through the research of this article, we hope to provide theoretical basis and practical guidance for the construction of the personal bankruptcy system of our country and promote the further perfection of the bankruptcy legal system.
