%X 个人信息是信息社会的基础资源&#65292;其开发和利用对于信息社会的进一步发展意义重大。个人信息合理使用制度的内涵可以总结为&#65306;法定合理使用范畴下个人信息的使用、处理等无需取得数据主体的同意&#65307;合理使用制度在处理非匿名个人信息时适用&#65307;主要旨在保护社会公共利益和国家安全利益不受损害。通过构建个人信息合理使用制度&#65292;从而在个人层面促进个人利益的公益保护&#65292;在社会层面实现公序良俗的价值倡导&#65292;在行政层面依法规范公共行政&#65292;在刑事层面划清个人信息利用的法律界限。<br>Personal information is a fundamental resource in the information society, and its development and utilization are of great significance for further societal advancement. The connotation of the fair use principle for personal information can be summarized as follows: the use and processing of personal information within the scope of statutorily defined reasonable use do not require the consent of the data subject; the fair use principle applies to the processing of non-anonymous personal information; and it primarily aims to protect the public interest and national security from harm. By establishing a fair use principle for personal information, the following objectives can be achieved: promoting public interest protection of individual rights on a personal level, advocating for public order and moral values on a societal level, legally regulating public administration on an administrative level, and defining the legal boundaries of personal information utilization on a criminal level.
