%X 数字经济时代，数据作为新型生产要素，发挥着不可替代的作用。大数据也是平台企业获取竞争优势，阻碍其他经营者进入市场，排除或者限制市场竞争的方式和手段。因此，基于数据而产生的平台企业数据垄断引发反垄断领域的广泛关注。但是因为互联网平台的数据垄断相较于传统行业的垄断具有更强的隐蔽性，想要从根源上解决数据垄断的问题，需要认清数据的法律属性。同时随着国家数据局的问世，结合国家的政策方向，数据共享是未来数据发展的主要方向，为了平衡各方利益，数据共享制度的构建显得尤为重要。
In the era of the digital economy, data plays an irreplaceable role as a new production factor. Big data is often used by platform enterprises to gain a competitive advantage, impeding the entry of other operators in the market, and excluding or limiting market competition by various means. Therefore, the big data monopoly of platform enterprises has attracted widespread attention in the antitrust field. However, because the data monopoly of internet platforms is more concealed compared to traditional industries, recognizing the legal attributes of data is essential in order to solve the problem of data monopoly from the root. At the same time, with the establishment of the National Bureau of Data and combining it with national policy direction, data sharing is the core of future data development, and establishing a data sharing system is essential to balance the interests of all parties involved.
