Strategies for the Chinese-to-English Translation of Modal Verbs in Legal Texts: A Case Study of the Maritime Code of the People’s Republic of China %A 杜红萱 %J Modern Linguistics %P 314-321 %@ 2330-1716 %D 2025 %I Hans Publishing %R 10.12677/ml.2025.133266 %X 《中华人民共和国海商法》作为我国商法特别法之一，维护和保障了海运和船舶各方权益。对海商法语言和翻译的研究，有利于促进海上运输，最终促进我国经济贸易发展，其宏观上是对法律翻译的研究。法律文本要求表达严谨、正式、准确，一字一句都要仔细斟酌。其中，情态动词的翻译是译员难以把握、容易出错的难点。本文基于文本类型理论、结合现有研究成果，将法律文本归类为表达型文本和信息型文本，以《中华人民共和国海事法典》(1992)的原文和2021年修订的最新官方英译为案例，尝试分析其译文文本类型及特征、译文中情态动词的翻译策略、提取一般性规律。在案例分析基础上得出法律文本翻译主要采用异化翻译策略，并分析其原因。同时，在整个翻译过程中要充分考虑文体因素，以具体文本类型的翻译策略为指导原则之一。
As one of the special laws in China’s commercial law system, Maritime Code of the People’s Republic of China safeguards the rights and interests of all parties involved in maritime transportation and shipping. Research on the language and translation of maritime law is instrumental in facilitating maritime transport and ultimately promoting China’s economic and trade development, representing a macro-level exploration of legal translation. Legal texts demand rigorous, formal, and translators precise and expression is prone to every error word. and Based phrase on requiring text careful type consideration theory. Among combining these existing, research the findings translation, of this modal paper verbs categorize a legal significant texts challenge into expressive and informative texts text. Using the original version of the Maritime Code of the People’s Republic of China (1992) and its latest official English translation, revised in 2021 as a case, this paper attempts to analyze the translation strategies of modal verbs and extract general patterns. Based on the case study, it concludes that foreignization is primarily adopted in legal text translation and analyzes the reasons behind this.
