%X 好意同乘是一种典型的情谊行为&#65292;本身不具有法律拘束力。但若发生交通事故&#65292;它即可转化为情谊侵权行为并构成情谊侵权责任。在我国司法实践中&#65292;关于好意同乘的界定、好意同乘致害的责任构成与限制等仍存在争议&#65292;未能达成共识。明晰此类问题有助于发挥法律对好意同乘关系当事人的保护作用&#65292;维护社会公平正义&#65292;更好地实现社会主义核心价值观中的和谐、友善价值。<br>Goodwill ride is a typical friendship behavior, itself has no legal binding force. However, if a traffic accident occurs, it can be transformed into a friendship tort act and constitutes a friendship tort liability. In the judicial practice of our country, there are still disputes about the definition of goodwill ride and the composition and limitation of liability caused by goodwill ride. Clarifying such issues will help to play the protective role of the law for the parties involved in the relationship of goodwill ride, maintain social fairness and justice, and better realize the value of harmony and friendship in the core values of socialism.
