%X 职业打假作为揭露和打击制假售假行为、提升消费者的维权意识、促进市场公平竞争的一种手段，发挥着维护市场秩序的重要作用。然而，《消费者权益保护法》及市场监管法律法规所规定的惩罚性赔偿制度正在成为许多职业打假人牟利的工具。知假买假、恶意索赔乃至敲诈勒索等现象为商家带来了很大的困扰，同时使执法监管部门花费了大量调查、处置的时间，产生了不必要的行政成本。市场监管部门对此可以通过完善法律、落实容错纠错机制、提升执法素质、推进社会共治等多种方式规制职业打假行为。
As a means of exposing and combating counterfeiting and illegal sales, professional product inspection plays an important role in maintaining market order by raising consumer’s awareness of rights protection and promoting fair competition in the market. However, the punitive compensation system stipulated in the Consumer Rights Protection Law and other market supervision laws is becoming a tool for many professional product inspectors to make profits. The phenomena of buying counterfeit products intentionally, malicious compensation claims, and extortion have caused great trouble for merchants and have led to a considerable amount of investigation and disposal time for law enforcement and regulatory departments, generating unnecessary administrative costs. Market supervision departments can regulate professional product inspection behavior through various means, such as improving laws, implementing error correction mechanisms, enhancing law enforcement quality, and promoting social governance.
