Research on Laws for the Protection of Consumers’ Rights and Interests in Electronic Commerce %A 吴长梅 %J E-Commerce Letters %P 2305-2309 %@ 2168-5851 %D 2025 %I Hans Publishing %R 10.12677/ecl.2025.141289 %X 近年来,随着数字经济和互联网经济的高速发展,“数字中国”“网络强国”已经成为我国经济发展的指向标,电子商务已成为现代社会的重要组成部分。电子商务在为消费者带来便利的同时也引发了一系列社会问题。本文旨在研究电子商务环境下消费者权益的保护,分析当前法律实践中存在的挑战和不足。研究发现,电子商务中的消费者权益保护面临诸多问题,如消费者权益保护机制不完善,消费者维权难度大,法律法规和监管体系不健全,电商平台责任落实不到位等问题。尽管已有诸如《消费者权益保护法》和《电子商务法》等相关法律法规,但在实际操作中依然存在诸多法律适用难题。本研究从法学视角出发,对这些法律难题进行分析,并提出一系列改进建议。研究强调,为构建一个更加安全的电子商务环境,必须从立法、执法、司法三条道路进行加强,才能更好促进电子商务市场的健康发展。
In recent years, with the rapid development of digital economy and internet economy, “Digital China” and “Network Power” have become the target of our economic development, and e-commerce has become an important part of modern society. While e-commerce brings convenience to consumers, it also causes a series of social problems. The purpose of this paper is to study the protection of consumer’s rights and interests under the e-commerce environment, and to analyze the challenges and deficiencies in the current legal practice. The study found that the protection of consumer rights and interests in e-commerce is faced with many problems, such as imperfect protection mechanism of consumer rights and interests, difficulty of protecting consumer rights, imperfect laws and regulations and supervision system, and e-commerce platform responsibility implementation issues such as not in place. Although there are some laws and regulations such as Consumer Protection Law and e-commerce law, there are still many problems and difficulties in the application of law in practice. This study analyzes these legal challenges from a legal perspective and proposes a series of improvement suggestions. The research emphasizes that in order to build a more secure e-commerce environment, we must strengthen the legislation, law enforcement, and justice, so as to better promote the healthy development of e-commerce market. %K 电子商务, %K 消费者权益, %K 法律保护
