%X 跨区域的流动人口管理是涉及治安和自由两个层面的管辖问题,各省纷纷出台了相应的流动人口管理办法。各地制定的管理办法是否合宪成为研究流动人口法规无法避开的一个重要话题。流动人口的个人信息事关其重要权益,以分析地方性流动人口管理办法中对流动人口概念的界定以及信息登记的方式为研究流动人口法规的起点,进而进行地方性流动人口管理办法的合宪性审查。明确地方流动人口管理办法中信息登记的负责主体和其收集流动人口个人信息的权限,以及流动人口个人信息收集的范围,可以更好地协调权利主体双方的利益平衡。探析流动人口个人信息收集中知情同意规则的价值和流动人口的人身自由,以更清晰地明确权利的界限。
Cross-regional management of the mobile population involves two levels of jurisdiction: public security and freedom. Various provinces have introduced corresponding measures for managing the mobile population. Whether the management measures formulated by various regions are constitutional has become an important topic that cannot be avoided when studying the regulations on the migrant population. The personal information of the floating population is related to their important rights and interests. Starting from the analysis of the definition of the concept of floating population and the way of information registration in the local floating population management measures, this study aims to conduct a constitutionality review of the local floating population management measures. Clarifying the responsible parties for information registration and their authority to collect personal information of the floating population in the local management measures for the floating population, as well as the scope of collecting personal information of the floating population, can better coordinate the balance of interests between the rights holders. Exploring the value of informed consent rules in the collection of personal information of the floating population and the personal freedom of the floating population in order to clarify the boundaries of rights more clearly.
