The Legal Path of Personal Information Protection—The Boundary and Application of Privacy Right and Personal Information Right %A 段清源 %J Open Journal of Legal Science %P 7467-7475 %@ 2329-7379 %D 2024 %I Hans Publishing %R 10.12677/ojls.2024.12121057 %X 随着《民法典》的实施和《个人信息保护法》的出台,我国公民的隐私权与个人信息权得到了进一步的法律保障。本文旨在探讨在数据时代背景下,隐私权与个人信息权的界分及其在法律适用上的挑战。个人信息作为两者重叠的领域,其保护客体的界定和权利冲突在司法实践中尤为突出。本文分析了现有民法典保护路径的局限性,并指出了隐私权与个人信息权在保护范围上的重叠问题。文章提出,为了解决这一困境,需要在立法层面对个人信息进行明确定义,并确立隐私权在民法中的优先适用原则。通过这一路径,可以更有效地协调隐私权与个人信息权的保护,以适应数字时代的法律需求。本文通过比较法研究和案例分析,为我国个人信息保护法律路径的优化提供理论支持和实践指导。
With the implementation of the “Civil Code” and the promulgation of the “Personal Information Protection Law”, the privacy and personal information rights of Chinese citizens have been further legally protected. This article aims to explore the boundary between privacy rights and personal information rights in the context of the data age, as well as the challenges in their legal application. As an overlapping field, the definition of the protected object and the conflict of rights of personal information are particularly prominent in judicial practice. This article analyzes the limitations of existing civil code protection paths and points out the issue of overlap between privacy rights and personal information rights in terms of protection scope. The article proposes that in order to address this dilemma, it is necessary to provide a clear definition of personal information at the legislative level and establish the principle of priority application of privacy rights in civil law. Through this path, the protection of privacy and personal information rights can be more effectively coordinated to meet the legal needs of the digital age. This article provides theoretical support and practical guidance for optimizing the legal path of personal information protection in China through comparative law research and case analysis. %K 个人信息, %K 隐私权, %K 个人信息权, %K 法律路径
