%X 刑事司法救济保护制度在捍卫公民权益、促进社会公正中扮演着关键角色。当前，司法救助已成为人民法院化解社会矛盾、优化社会管理的重要途径。特别是在涉及企业商业秘密保护的案件中，人民法院通过司法救助，尤其是刑事附带民事诉讼的方式，成为解决纠纷、激发社会管理创新的有效工具。这种方式不仅助力受害企业迅速获得经济赔偿，减轻因侵权行为造成的损失，还能促使侵权方真诚道歉、积极赔偿，从而在一定程度上修复受损的商业关系和市场秩序。然而，立法层面的不足导致救济范围、标准和程序存在模糊，增加了实际操作难度；资金短缺则直接限制了救济措施的有效实施，使得部分受害企业难以获得及时、充分的赔偿。此外，操作过程中的不规范现象，如救济申请流程复杂、审批效率低下、执行不力等问题，也严重削弱了救济制度的公信力和实际效果。因此，我国现行的企业商业秘密司法救济制度亟待进一步完善，更有效地保护企业商业秘密，维护市场秩序，促进社会公平正义。
The criminal justice relief protection system plays a crucial role in safeguarding citizens’ rights and promoting social justice. Currently, judicial relief has become an important means for people’s courts to resolve social conflicts and optimize social management. In particular, in cases involving the protection of commercial secrets, people’s courts have effectively utilized judicial relief, especially through the mechanism of criminal incidental civil lawsuits, to resolve disputes and stimulate innovation in social management. This approach not only helps the affected enterprises quickly obtain economic compensation and mitigate losses caused by infringement but also encourages the infringing parties to sincerely apologize and actively compensate, thereby somewhat restoring damaged business relationships and market order. However, deficiencies at the legislative level have led to ambiguities in the scope, standards, and procedures of relief, increasing the practical operational difficulties. Additionally, funding shortages directly limit the effective implementation of relief measures, making it difficult for some affected enterprises to receive timely and adequate compensation. Furthermore, irregularities during the operational process, such as complicated relief application procedures, low approval efficiency, and ineffective enforcement, have severely undermined the credibility and actual effectiveness of the relief system. Therefore, the current judicial relief system for enterprise commercial secrets in China urgently needs further improvement to more effectively protect commercial secrets, maintain market order, and promote social fairness and justice.
