%X 《民法典》中的第十条延续了《民法总则》中的规定&#65292;将民事习惯作为必要时判案的依据。但由于民事习惯的复杂性及其法律渊源中的地位&#65292;须以文义解释和目的解释来确定民事习惯的适用效力和适用方式。民事习惯的正确适用能有效弥补成文法的不足&#65292;但法院在司法裁判中一般不适用习惯或是适用民事习惯的方式太过粗略。为保证我国民事习惯司法适用的进一步推进&#65292;有必要结合相关案例以及国内外民事习惯适用的优秀经验。对经典常用的民事习惯进行汇编整理&#65292;构建专业的案例指导制度&#65292;并明确在法律文书中引用民事习惯的规范和方法。<br>Article 10 of the &#8220;Civil Code&#8221; continues the provisions of the &#8220;General Principles of Civil Law&#8221; and takes civil customs as the basis for judging cases when necessary. However, due to the complexity of civil custom and its status in the source of law, it is necessary to determine the applicable effect and application mode of civil custom by means of literal interpretation and purpose interpretation. The correct application of civil custom can effectively make up for the deficiency of statute law, but the court generally does not apply custom in judicial judgment or the way of applying civil custom is too rough. In order to ensure the further advancement of the judicial application of civil customs in China, it is necessary to combine relevant cases and excellent experience in the application of civil customs at home and abroad. Compile and sort out the classic civil habits, construct a professional case guidance system, and clarify the norms and methods of citing civil habits in legal documents.
