%X 本研究旨在通过夏代的经济法分配思想作为切入点,并溯及其法源,指出最初是以“应报理论”为内核来作为经济资源的分配思想,当时的祭祀活动也与经济资源的分配有着紧密的联系,关乎于国家、社会以及人民的生活,通过本研究可以发现经济法当中的分配权在夏代已经开始萌芽,也是中国经济法律思想的初始发展阶段。本研究丰富了夏代经济分配思想的内涵,并从历史与法律的角度深化经济法的起源与发展规律,也为日后的经济法律思想史研究提供了启发。
This study aims to use the economic distribution thought of the Xia Dynasty as an entry point, tracing its legal origins to highlight that the early foundation of economic resource distribution was centered on the “Theory of Reciprocal Obligation”. At that time, ritual activities were closely intertwined with the distribution of economic resources, impacting the lives of the state, society, and the people. Through this research, it is revealed that the concept of distributive rights within economic law began to emerge during the Xia Dynasty, marking the initial development stage of Chinese economic legal thought. This study enriches the understanding of economic distribution thought in the Xia Dynasty and deepens insights into the origins and development patterns of economic law from historical and legal perspectives, providing valuable inspiration for future research on the history of economic legal thought.
