Study on the Self-Supplementary Investigation Mechanism of Criminal Cases %A 李婷 %J Open Journal of Legal Science %P 7303-7310 %@ 2329-7379 %D 2024 %I Hans Publishing %R 10.12677/ojls.2024.12121035 %X 自行补充侦查机制是法律赋予检察机关对案件补充侦查及监督的正当制度。从自行补充侦查的立法规范及相关文件的直接解读和“案–件比”案件质效评价机制的辅助解读去阐明该制度的立法初衷,基于立法初衷明了其适用应有之义以及其应达到的实施效果。以实务数据分析可以梳理出自行补充侦查机制的适用现状。从以上数据中可以较为直观的发现自行补充侦查制度在实务中具有适用的被动性、随意性、变动性较强的不足之处。因此有必要对以上不足提出相应的完善意见,通过转变适用观念、促进检警合作提升主动性;内外联动加强监督改善随意性;有序推进“案–件比”评价体系、严格执行补充侦查适用原则使得适用的变动性强、稳定性不足的形势平稳化、常态化。
The self-supplementary investigation mechanism is a legitimate system for procuratorial organs to make supplementary investigation and supervision of cases. The legislative original intention of the system is clarified from the direct interpretation of the legislative norms of self-supplementary investigation and the auxiliary interpretation of the “case-case ratio” of the evaluation mechanism of the system, based on the proper meaning of its application and the implementation effect that should be achieved. The practical data analysis can sort out the applicable status quo of the self-supplementary investigation mechanism. From the above data, it can be intuitively found that the self-supplementary investigation system has the shortcomings of applicable passivity, randomness and strong variability in practice. Therefore, it is necessary to put forward corresponding perfect opinions on the above deficiencies, and enhance the initiative by changing the application concept and promoting the police cooperation; strengthen the internal and external linkage supervision and improve the randomness; promote the “case-case ratio” evaluation system, and strictly implement the applicable principle of supplementary investigation, making the applicable situation of strong variation and insufficient stability stable and normalized. %K 自行补充侦查, %K 实务工作, %K “ %K 案– %K 件比” %K , %K 法治发展
