%X 政府数据作为“生产要素”，在现代工业社会、数字经济中越发重要，政府数据开放能巩固我国数字经济全球领先地位，促进我国高端服务业的发展。推进政府数据开放利用，已成为推进国家治理体系和治理能力现代化的重要手段，也是推动数据这一生产要素更好发挥其价值的必由之路，对于赋能现代治理、赋能经济发展、赋能共同富裕具有重要的意义。本文基于地方立法与实践，分析了地方政府数据开放的管理体制与运行机制，并对相关地方法律文本进行研究分析，发现当前我国地方政府数据开放立法还存在地方立法文本质量低内容样板化，精细化程度低。个人隐私及商业机密保护深度欠缺等问题。对于这些问题，本文提出了加强顶层法律体系建设，提高地方立法精细化的建议。由此，可以制定更加完善的法律法规，为政府数据开放提供更有力的法律保障，为数字时代的创新发展提供更加坚实的基础。
As a “factor of production”, government data is becoming more and more important in the modern industrial society and digital economy, and the openness of government data can consolidate China’s global leading position in the digital economy and promote the development of China’s high-end service industry. Promoting the open use of government data has become an important means to promote the modernization of the national governance system and governance capacity, and it is also the only way to promote the value of data, a factor of production, which is of great significance for empowering modern governance, economic development, and common prosperity. Based on local legislation and practice, this paper analyses the management system and operation mechanism of local government data openness, and analyses the relevant local legal texts. Lack of protection of personal privacy and trade secrets. In view of these problems, this paper puts forward suggestions for strengthening the construction of the top-level legal system and improving the refinement of local legislation. As a result, more complete laws and regulations can be formulated, providing stronger legal guarantees for government data openness, and providing a more solid foundation for innovation and development in the digital era.
