A Study on the Legal Construction for the Protection of Women’s Rights and Interests in China %A 杨菊 %J Open Journal of Legal Science %P 7142-7149 %@ 2329-7379 %D 2024 %I Hans Publishing %R 10.12677/ojls.2024.12121014 %X 妇女权益保障是人民权益保障的重要组成部分，是坚持中国人权发展道路的重要一环。新中国成立以来，我国一直高度重视妇女事业发展，将妇女发展工作放在重要位置。我国在妇女权益保障中取得诸多显著成果，妇女权益保障从道德层面上升至国家意志，逐步形成了以宪法为基础、妇保法为主体的相关法律体系。但就现实而言，妇女权益保障还存在诸多问题，矮化女性的广告桥段屡禁不止，隐蔽复杂的家庭暴力长期存在，隐性间接的性别歧视维权不易，归根结底是相关法律法规有待完善，相关法律法规威慑力不足以及相关人员法治意识不强，继而造成法律规定与实践的现实落差。本文以妇女权益保障为研究对象，总结我国妇女权益保障在国家意志上取得的历史性成就，分析妇女权益保障存在的现实落差，从立法、执法、司法和普法四个维度提出完善建议，期望进一步提升我国妇女权益保障水平。
The protection of women’s rights and interests constitutes a crucial component of the protection of people’s rights and interests and is an essential aspect of adhering to the path of human rights development in China. Since the establishment of the People’s Republic of China, our country has always placed great emphasis on the development of women’s causes and given significant priority to the work related to women’s development. China has attained numerous remarkable achievements in the protection of women’s rights and interests. The protection of women’s rights and interests has ascended from the moral level to the national will, gradually forming a relevant legal system with the Constitution as the foundation and the Law on the Protection of Women’s Rights and Interests as the main body. However, in reality, there are still numerous issues in the protection of women’s rights and interests. Demeaning advertisements targeting women persist despite repeated prohibitions. Hidden and complex domestic violence exists for a long time. The safeguarding of rights against covert and indirect gender discrimination is not easy. Ultimately, the relevant laws and regulations need to be refined, their deterrent force is insufficient, and the legal awareness of the relevant personnel is not strong, thereby resulting in a gap between the legal provisions and the practical reality. This paper takes the protection of women’s rights and interests as the research object, summarizes the historical achievements made in the protection of women’s rights and interests in terms of national will in our country, analyzes the practical gap in the protection of women’s rights and interests, and puts forward improvement suggestions from the four dimensions of legislation, law enforcement, judicial practice, and legal popularization, with the expectation of further enhancing the level of protection of women’s rights and interests in our country. %K 权益保障， %K 妇女， %K 中华人民共和国妇女权益保障法， %K 妇女权益
