Research on the Legal Protection of Working People’s Offline Rights in the Digital Age %A 王肇文 %J Open Journal of Legal Science %P 6852-6857 %@ 2329-7379 %D 2024 %I Hans Publishing %R 10.12677/ojls.2024.1212973 %X 在互联网快速发展的数字信息时代,数字劳动生产方式下的数字劳动关系具有灵活性、高效性等特征,智能化远程办公被广泛使用,劳动者工作时间与休息时间的界限变得模糊,而数字时代劳动者的休息权保障问题对于构建数字经济时代的和谐劳动关系具有重要影响。隐形加班问题不仅侵害了劳动者的休息权、健康权等权益,而且不利于整个社会的公正发展。同时随着数字信息技术和“线上”办公的普及发展,劳动者休息权不可避免地被侵害且缺乏一定的法律保护,因而有必要在我国劳动法律法规中明确离线权,并不断提高劳动者离线权的维权意识,以促进数字时代和谐劳动关系的构建。
In the rapid development of the Internet age of digital information, digital labor production under the mode of digital labor relations has the characteristics of flexibility, efficiency, intelligent remote office is widely used, the boundaries between laborer working time and rest time become blurred, and the digital age of laborer rest right of digital economy harmony labor relations has an important influence. The problem of invisible overtime not only infringes on the workers’ right to rest and health, but also is not conducive to the fair development of the whole society.
