Research on the Characterization of Criminal Law on Cyber Violence from the Perspective of Criminal Integration %A 刘梦 %J Open Journal of Legal Science %P 7055-7062 %@ 2329-7379 %D 2024 %I Hans Publishing %R 10.12677/ojls.2024.12121002 %X 刑法语境中对“网络暴力”进一步研究困境症结在于传统刑法对其法律属性、体系定位空白。不可触摸的互联网作为暴力行为的直接载体,使大范围、高密度的“人言”对某个特定主体变得“可畏”,进而造成对特定主体的社会工作、生活、限制性因素,甚至导致心理和生理双重创伤。网络暴力按时间维度主要包括三种形式:言辞暴力、人肉搜索和延伸至现实中的滋扰行为。上述行为分别可能涉及侮辱罪、诽谤罪和侵犯公民个人信息罪等罪名。此外,特定情境下对网络暴力的刑事定性需格外谨慎,充分考虑其与网络舆论监督的区别及公众人物面对信息公开的额外容忍度。刑法上处理网络暴力案件既要维护个体权益,又需考虑言论自由和公共监督的价值,于多元维度中实现网络空间的长效治理。
The crux of the dilemma of further research on “cyber violence” in the context of criminal law lies in the lack of traditional criminal law in its legal attributes and system positioning. As a direct carrier of violence, the untouchable Internet makes a wide range and high density of “human speech” “terrifying” to a specific subject, which in turn causes social work, life, and restrictive factors for a specific subject, and even leads to psychological and physical trauma. There are three main forms of online violence in terms of time: verbal violence, doxing, and nuisance behavior that extends to reality. The above-mentioned acts may involve crimes such as insult, defamation, and infringement of citizens’ personal information. In addition, the criminal characterization of online violence in specific contexts needs to be extremely cautious, fully considering the difference between it and online public opinion supervision and the additional tolerance of public figures in the face of information disclosure.
