%X 本研究从以下三个方面进行了探讨:首先,分析现行《教师法》,发现其在教师权益保护方面存在教师的法律身份不明确、教师权利具体内容有待完善、侵权责任追究机制有待完善、教师救济制度有待健全等问题;其次,分析《中华人民共和国教师法(修订草案) (征求意见稿)》中对教师权益保护部分做出的完善性修订;最后,针对现存问题,提出进一步加强教师权益保护的建议,如明确教师的法律身份、健全教师权益救济机制等。
The study discusses the issue of teacher rights protection from the following three aspects: Firstly, it analyzes the current “Teacher’s Law”, and finds that there are problems in the protection of teachers’ rights, such as the unclear legal status of teachers, the need to further improve the specific content of teachers’ rights, the need to improve the mechanism for investigating infringement liabilities, and the need to improve the teacher relief system. Secondly, it analyzes the improvements made in the protection of teachers’ rights in the draft revision of the “Teacher Law of the People’s Republic of China” (draft for comments). Finally, it proposes suggestions for further strengthening the protection of teachers’ rights, such as clarifying the legal status of teachers and improving the teacher rights relief mechanism, in response to the existing problems.
