%X 数字技术的飞速发展，不仅推动人类社会迈入新阶段，同时也推动着传统劳动方式的迭代更新，以跨越时空界限的远程劳动或平台劳动应运而生，并成为劳动的主要方式。在数字经济发展的背景下，出现的新用工模式和工作方式在利好发展的同时，也在隐性地侵犯劳动者的休息权，损害劳动者的合法权益。本文从数字经济时代劳动者休息权的概述出发，通过分析劳动者休息权的当代特征，透过劳动者和用人单位两个主体，明晰新时代保障劳动者休息权的困境，并据此提出可供借鉴的解决路径，依法全过程保障劳动者的休息权。
The rapid development of digital technology not only drives human society into a new stage, but also promotes the iteration and updating of traditional labor methods. Remote labor or platform labor that crosses time and space boundaries have emerged and become the main way of labor. In the context of the development of the digital economy, the emergence of new employment models and work methods not only benefits development, but also implicitly infringes on workers’ right to rest and damages their legitimate rights and interests. Starting from an overview of workers’ right to rest in the digital economy era, this article analyzes the contemporary characteristics of workers’ right to rest, clarifies the dilemma of safeguarding workers’ right to rest in the new era through the two main bodies of workers and employers, and proposes a solution path for reference based on this, ensuring workers’ right to rest throughout the entire legal process.
