A Brief Analysis of Property Rights Determination and Legal Protection of Enterprise Derivative Data %A 童修权 %J Open Journal of Legal Science %P 6773-6780 %@ 2329-7379 %D 2024 %I Hans Publishing %R 10.12677/ojls.2024.1212961 %X 明确的产权归属是现代交易的前提。在推动数字经济发展和促进数据开发利用的背景下，数据的法律性质及权利的归属重要性不言而喻。然而，现行立法并未确定数据的权利性质和归属，理论界对于是否采取确权保护模式以及数据的权利性质均存在较大争议。特别是在企业拥有的匿名化的衍生数据能否由企业享有所有权这一方面，众说纷歧。这将不利于对企业数据权益的保护，进而也会影响数据交易的进一步发展。因此，本文将从数据开发利用和促进数据交易的角度出发，分析目前我国企业数据产权保护制度的现状与不足，比较分析企业数据司法保护模式；基于实践中企业衍生数据使用情况，在探讨企业衍生数据产权确定的正当性的基础上，尝试提出一个可行的确权保护模式，为未来立法中完善企业数据产权保护制度提供思路。
Clear ownership of property rights is a prerequisite for modern transactions. In the context of promoting the development of the digital economy and facilitating the development and utilization of data, the importance of the legal nature and ownership of data rights is self-evident. However, the current legislation has not determined the nature and ownership of data rights, and there is significant controversy in the theoretical community regarding whether to adopt a rights protection model and the nature of data rights. There are different opinions on whether anonymous derivative data owned by enterprises can be owned by them. This will not be conducive to the protection of enterprise data rights and interests, and will also affect the further development of data transactions. Therefore, this article will analyze the current situation and shortcomings of China’s enterprise data property protection system from the perspective of data development and utilization, as well as promoting data transactions, and compare and analyze the judicial protection models for enterprise data; Based on the practical use of enterprise derived data, this paper explores the legitimacy of determining the property rights of enterprise derived data and attempts to propose a feasible model for property rights protection, providing ideas for improving the system of enterprise data property rights protection in future legislation. %K 企业衍生数据， %K 数据产权， %K 数据立法
