%X 随着经济快速发展，现代化城市建设的脚步不断加快，高层住宅数量也随之增多，生活中频频出现高空抛物、坠物的现象，人在地上走，祸从天上来，严重危害了人们的生命健康安全以及公共安全。民有所呼，法有所应，我国的民法典针对高空抛物问题进行细致的规定,“禁止从建筑物中抛掷物品”，并且清晰地明确了高空抛物可能造成加害建筑物使用者的法律责任、物业服务企业的法律责任以及公安机关在高空抛物处置中的调查职责。此外刑法修正案(十一)也将“高空抛物罪”作为新罪名单独入刑，将高空抛物行为规制在了妨碍社会经济管理和秩序下的干扰公共秩序的行为罪中，降低了入罪门槛，实现了罪责相适应，法律惩治更加精准完备。通过刑法规制高空抛物行为，与民法典的相关规定相协调，弥补了体系性不足的缺陷。民刑衔接，正是对陋习的有力震慑，也标志着国家从法律上遏制高空抛物这一不文明行为的约束力愈加强硬。本文主要以《民法典》关于高空抛物的条文和刑法修正案(十一)为视角剖析高空抛物、坠物的法律责任承担，限定可能加害的建筑物使用人的范围，建立健全高空抛物受害人的救济制度，最大必要程度保护受害者的正当权利和利益。
With the rapid economic development, the pace of modern city construction is accelerating, the number of high-rise residential buildings is also increasing, life frequently appeared in the pheno-menon of throwing objects from high altitude, falling objects, people walk on the ground, disaster from the sky, seriously endangering people’s life and health safety and public safety. People shout, law should be somewhat, the civil code of the provisions of the detailed for high altitude parabolic problem “no throwing objects from the building”, and clearly define the high altitude parabolic may harm caused by building the user’s legal responsibility, legal responsibility of realty service enterprise, and the public security organ in the high altitude parabolic disposal investigation duties. In addition, the Amendment (XI) to the Criminal Law also included “throwing objects from above” as a new crime, regulating throwing objects from above into the crime of interfering with social and economic management and public order, lowering the threshold of entry to the crime, realizing the adaptation of the crime to the crime, and making the legal punishment more accurate and complete. The regulation of throwing objects from high altitude through the criminal law is coordinated with the relevant provisions of the Civil Code and makes up for the deficiency of the system. Civil punishment convergence, is a strong deterrent to bad habits, also marks the country from the law to curb the throwing of objects from high altitude this uncivilized behavior of the binding force is increasingly strong.
