%X 互联网飞速发展和普及在为人们生活提供便捷的同时&#65292;还引发了网络环境中的网络暴力问题。本文系统分析了我国现行网络暴力法律规制的现状&#65292;指出其中存在的立法缺失、网络平台监控不足、侵权责任不够明确的问题。为了预防和惩治网络暴力&#65292;我们应当从立法、执法和司法的角度&#65292;出台专项法律法规、构建预防机制、细化网络暴力相关司法解释&#65292;以此建立一个健康有序的网络空间环境。<br>The rapid development and popularization of the Internet not only provides people with convenient life, but also triggers the problem of network violence in the network environment. This paper systematically analyzes the current situation of legal regulation of cyber violence in China, and points out the problems of missing legislation, insufficient monitoring of network platforms, and lack of clarity of tort liability. In order to prevent and punish cyber violence, we should, from the perspective of legislation, law enforcement and justice, introduce special laws and regulations, build a preventive mechanism, and refine the judicial interpretation of cyber violence, so as to establish a healthy and orderly cyberspace environment.
