%X 电商平台与其用户之间存在着持续的信息不平等关系,在此背景下为了有效保护用户的个人信息安全,我国个人信息保护法围绕“告知同意”规则为核心建立个人信息保护规则,确立了对用户进行信息赋权,对平台施加责任的进路。然此种进路在施行之中出现了用户信息权利形式化以及用户独自承担更多未来风险之问题。信任是社会秩序稳定并良性发展的关键之所在,在对用户进行倾斜保护模式中建立用户与平台间信任关系,引入平台的信息信义义务可有效缓解目前个人信息保护所出现之问题。
E-commerce platforms and their users have a continuous relationship of information inequality, in this context, in order to effectively protect the security of users’ personal information, China’s personal information protection law establishes personal information protection rules centered around the rule of “notification of consent”, and establishes a path of empowering the user with information, and imposing liability on the platform. However, the implementation of this approach has resulted in the formalisation of users’ information rights and the assumption of more future risks by users alone. Trust is the key to the stability and benign development of social order, and the establishment of a trust relationship between users and platforms and the introduction of platforms’ information trust obligations in the mode of tilted protection of users can effectively alleviate the current problems in the protection of personal information.
