The Reapplication of Cicero’s Theory of Persuasion %A 刘银翠 %J Interdisciplinary Science Letters %P 177-182 %@ 2574-416X %D 2024 %I Hans Publishing %R 10.12677/isl.2024.83022 %X 西塞罗是古罗马时期对后世修辞理论和实践影响最大的修辞学家,他以雄辩著称,留下了众多法庭演说词,但是对于西塞罗说服理论的研究却少之又少,因此本文首先对西塞罗的法律修辞溯源,明确西塞罗的法律修辞的五大要素,之后选取西塞罗法律修辞思想中的“发现”理论进行深入探究,明确理性说服与情感说服的基本要素,进而从现代论题学以及法律运行的角度,深入探讨西塞罗“发现”理论的现代化运用,为法律修辞的发展提供一定的借鉴。
Cicero is the rhetorician who had the greatest influence on the theory and practice of rhetoric in ancient Rome, he is known for his eloquence, and left many court speeches, but there is very little research on Cicero’s persuasion theory, so this paper first traces the origin of Cicero’s legal rhetoric, clarifies the five elements of Cicero’s legal rhetoric, and then selects the “discovery” theory in Cicero’s legal rhetoric thought for in-depth exploration, clarifies the basic elements of rational persuasion and emotional persuasion, and then from the perspective of modern thesis and legal operation, The modern application of Cicero’s “discovery” theory is discussed in depth, which provides some reference for the development of legal rhetoric. %K 西塞罗, %K 法律修辞, %K 说服理论, %K 论题学
