Study on the Writ-Based Principles in the Protection of Property Involved in the Case %A 罗丁乙 %J Dispute Settlement %P 122-129 %@ 2379-3104 %D 2024 %I Hans Publishing %R 10.12677/ds.2024.108361 %X 传统的刑事诉讼程序是一种“对人之诉”的形式,重定罪量刑、轻财产处置。现行《刑法》《刑事诉讼法》以及司法解释、指导性文件对刑事涉案财产处置的法律规定缺位、权责不清、专业性不强。刑事案件涉案财产处理程序既关系到依法惩罚犯罪,又与人权司法保障密切相关,应当给予足够的重视,相关概念也需要厘清。本文试图以加强侦查、起诉过程中财产处置的令状主义构建,保障有利害关系的第三人诉讼参与为进路,探寻涉案财产保护的不同解,以此促进我国刑事诉讼程序的合法性、合理性、文明性,适应我国经济社会发展新形势下涉案财产保护的新要求。
Traditionally, criminal procedure has been regarded as a form of “action in personam”, emphasizing conviction and sentencing over property disposal. The current Criminal Law of the People’s Republic of China, Criminal Procedure Law of the People’s Republic of China along with pertinent judicial interpretations and guiding documents exhibit deficiencies in their legal provisions for the disposal of criminally involved property, characterized by absence of legal provisions, unclear rights and responsibilities, and lack of professionalism. The procedures for handling criminally involved property in criminal cases are not only vital to the lawful punishment of crimes, but also intimately tied to the judicial protection of human rights. Consequently, ample attention should be given and the relevant concepts ought to be clarified. This article attempts to explore various solutions for safeguarding criminally involved property by strengthening the development of writ-based principles in property disposal during investigation and prosecution, while ensuring the participation of interested third parties in litigation proceedings, thereby enhancing the legitimacy, rationality, and civility of China’s criminal litigation framework to adapt to the new requirements of protection of property involved in the new situation of China’s economic and social development. %K 涉案财产, %K 令状主义, %K 比例原则, %K 司法审查
