%X 少捕慎诉慎押政策被确立为刑事司法政策以来,不捕率、不诉率、羁押率都达到了新的高度。随着互联网的发展,利用网络实施刑事犯罪高发。打击帮助信息网络犯罪活动罪作为检察机关推动网络空间安全清朗的重点之一,在办案过程中适用少捕慎诉慎押政策是全面落实该政策的重要体现。但在推行的过程中仍存在司法机关对逮捕条件把握情况不统一、相对不起诉的要件判断缺乏实质出罪思维、检察机关落实羁押期限控制乏力等问题。要把少捕慎诉慎押政策落到实处,应当细化社会危害性的实质审查、给予检察机关行使起诉裁量权的充分空间、构建羁押–刑罚相当性为核心的羁押审查机制。
Since the policy of fewer arrests, more cautious prosecutions and more cautious detentions was established as a criminal justice policy, the rates of no arrests, no prosecutions and no detentions have reached new heights. With the development of the Internet, there has been a high incidence of criminal offenses committed using the network. As one of the priorities of the procuratorial authorities in promoting the safety and clarity of cyberspace, the application of the policy of fewer arrests, more prudent prosecutions and more cautious detentions in the process of handling cases is an important manifestation of the full implementation of this policy. However, in the process of implementation, there are still judicial organs to grasp the conditions of arrest is not uniform, relative non-prosecution of the elements of the judgment of the lack of substantive crime thinking, procuratorial organs to implement the detention period control is weak and other issues. In order to put into practice the policy of fewer arrests, more prudent prosecutions and more prudent detentions, it is necessary to refine the substantive review of social harm, give the procuratorial authorities sufficient space to exercise prosecutorial discretion, and construct a detention review mechanism centered on detention-penalty equivalence.
