Research on Legal Protection of Consumer Rights and Interests in the Context of Intelligent Algorithms %A 韩栋源 %J E-Commerce Letters %P 7317-7324 %@ 2168-5851 %D 2024 %I Hans Publishing %R 10.12677/ecl.2024.133900 %X 人工智能算法背景下,算法在便利消费者的同时也带来了新的风险与挑战。智能算法所衍生出大数据杀熟、信息茧房、个人信息泄露等各种问题,不仅侵害了消费者的权益,而且阻碍了消费平台的发展以及加剧了社会信用危机,因此对算法的规制势在必行。对于算法规制,我国的法律规定尚有欠缺,无法充分保障消费者权益,本文通过对域外相关领域制度进行研究认为,首先要建立和完善算法审查机制,推动算法公开化透明化,其次要明确侵权责任,完善追责制度,最后要规范消费者信息的收集和使用并完善救济保障制度,以此来规制智能算法,保护消费者权益。
Under the background of artificial intelligence algorithms, algorithms not only facilitate consumers, but also bring new risks and challenges. The problems derived from intelligent algorithms, such as big data, information cocoon and personal information leakage, not only infringe on the rights and interests of consumers, but also hinder the development of consumption platforms and aggravate the social credit crisis. Therefore, it is imperative to regulate algorithms. For the regulation of algorithm, the legal provisions still exist in our country, which cannot fully protect the rights and interests of consumers. Therefore, based on the study of foreign related fields, this paper draws some conclusions. First, we should establish and perfect the algorithm review mechanism, promote the transparency of the algorithm, and second, we should clarify the tort liability and improve the accountability system. Finally, it is necessary to standardize the collection and use of consumer information and improve the relief and security system, so as to regulate the intelligent algorithm and protect the rights and interests of consumers. %K 消费者权益保护, %K 智能算法, %K 法律规制
