%X 未成年人巨额直播打赏事件频发&#65292;在引起社会关注的同时也引发了许多法律纠纷。梳理规制未成年人网络直播打赏的法律法规及主流直播平台的服务协议等&#65292;不难发现不同层级的规范性文件存在效力冲突&#65292;法院裁判观点存在分歧&#65292;不同平台之间的规定也不尽相同。本文针对系列问题进行理论分析&#65292;并提出了优化网络直播立法&#65292;厘清法院裁判观点&#65292;督促行业自律&#65292;加强行业监管的优化路径。<br>The frequent occurrence of huge live broadcast tips by minors has attracted social attention and also caused many legal disputes. It is not difficult to find that there are conflicts in the validity of normative documents at different levels, differences in court opinions, and different provisions between different platforms. This paper analyzes a series of issues theoretically, and proposes an optimization path to optimize the legislation of online live broadcasting, clarify the opinions of court judgments, urge industry self-discipline, and strengthen industry supervision.
