The Legal Regulation of Self-Preferential Behavior of Digital Platform under the Anti-Monopoly Law %A 董宇昊 %J Open Journal of Legal Science %P 4371-4379 %@ 2329-7379 %D 2024 %I Hans Publishing %R 10.12677/ojls.2024.127621 %X 数字平台的自我优待行为产生于数字经济的市场竞争之中,对该行为的规制我国虽然做到了立法先行,但立法中体现出行为“本身违法”的观点难以厘清行为违法的边界,且难以涵盖所有的自我优待行为。与此同时,该行为一方面提高了数字平台经济一体化效率,另一方面可能会排除与限制相关市场经营者的竞争,因此对于平台自我优待行为的规制需要以界定平台在相关市场的支配地位为基点,适用合理原则对自我优待行为进行违法性认定,重构平台抗辩规则并确立平台“守门人”义务,以促进数字平台经济的健康发展。
The self-preferencing of digital platforms arises from market competition in the digital economy. Although China has enacted legislation to regulate this behavior, it is challenging to clearly define the boundaries of illegal conduct by simply deeming the behavior “inherently illegal” in the law, and it is difficult to encompass all instances of self-preferential behavior. While this conduct enhances the efficiency of economic integration for digital platforms, it may also lead to exclusion and restriction of competition among relevant market operators. Therefore, regulating platform self-preferencing should be based on defining the dominant position of platforms in relevant markets, and determining the legality of such conduct through reasonable principles. To promote healthy development in the digital platform economy, we need to reconstruct platform defense rules and establish a “gatekeeper” obligation for platforms. %K 反垄断法,自我优待,合理原则,平台中立,必需设施
