%X 在法学研究的时代长河中，自由和正义的法价值是法学家们讨论最多、最为追求的价值范畴。著名经济学家、政治哲学家哈耶克亦在其著作《自由秩序原理》中对其自由观做出了详细的阐述和论证。但这种自由观在结构和实践上都存在一些问题，本文从自由的本质、福祉的正当性、社会进步的角度对其自由观的正义局限性进行分析，并对正义性的关键进行阐明。力求克服其自由观的弱点，引领自由主义走向更宽广的未来。<br />
In the long river of legal research, the legal values of freedom and justice are the most discussed and pursued value categories by legal scholars. Famous economist and political philosopher Hayek also provided a detailed exposition and argument on his views of freedom in his work <i>The Constitution of Liberty</i>. However, this view of freedom has some problems in both structure and practice. This article analyzes the limitations of its view of freedom in terms of the essence of freedom, the legitimacy of welfare, and social progress, and elucidates the key to justice, striving to overcome the weaknesses of its views of freedom and lead liberalism towards a broader future.
