%X 高速发展的市场经济不仅带来了频繁的经济交往活动，还在经济主体之间带来了因合同的签订、履行所引发的纠纷，这也给司法实践带来了一个十分棘手的问题：如何准确界分民事欺诈和合同诈骗罪。本文从合同诈骗罪和民事欺诈罪的概念出发，厘清区分合同诈骗罪与民事欺诈的原则，而后重点分析合同诈骗的认定，并从不同角度分析合同诈骗罪与民事欺诈的区分标准，从而更好地寻求界定合同诈骗罪与民事欺诈的路径与方向。<br />
The rapid development of the market economy has not only brought frequent economic exchanges, but also brought disputes between economic entities caused by the signing and performance of contracts, which has also brought a very difficult problem to judicial practice: how to accurately distinguish between civil fraud and contract fraud. Starting from the concepts of contract fraud and civil fraud, this paper clarifies the principles of distinguishing contract fraud from civil fraud, then focuses on the identification of contract fraud, and analyzes the distinguishing standards between contract fraud and civil fraud from different angles, so as to better seek the path and direction of defining contract fraud and civil fraud.
