Study on the Recognition of Labor Relationships of Internet Contract Workers in China %A 王茗 %J Open Journal of Legal Science %P 3397-3403 %@ 2329-7379 %D 2024 %I Hans Publishing %R 10.12677/ojls.2024.125482 %X 当下,互联网信息技术日益发展,网络平台经营者的出现为社会提供了许多新兴的职业、创造了大量的就业机会,带动了一大批灵活就业人员,简称“网约工”。但是,网约工用工形式由于兼具劳动关系和劳务的关系的双重特征,对我国的传统劳动关系发出了挑战,导致司法实务界同案不同判现象普遍。究其原因,主要包括劳动关系的相关法律概念僵化、“二分法”认定模式的缺陷、从属性认定标准存在弊端以及平台提供的协议极具迷惑性四个方面。针对这几个问题,首先需要明确劳动关系的相关法律概念;其次,丰富细化劳动关系从属性的认定标准;再次,构建劳动关系认定的“三分法”保护模式;最后,要求我国的相应监管部门加强对平台提供协议的监管。
Nowadays, the growing development of Internet information technology and the emergence of network platform operators have provided society with many new occupations, created a large number of employment opportunities, and led to a large number of flexible employment personnel, referred to as “net contract workers”. However, the net contract labor form of employment due to both labor relations and service relations of the dual characteristics of the traditional labor relations in China issued a challenge, leading to the judicial practice of the same case with a different phenomenon is common. The reasons for this include the rigidity of the relevant legal concepts of labor relations, the defects of the “dichotomous” identification model, the shortcomings of the subordinate identification standard, and the platform provided by the agreement is very confusing four aspects. In order to address these issues, it is necessary to firstly clarify the legal concept of labor relations; secondly, enrich and refine the criteria for determining the subordination of labor relations; thirdly, construct a “trichotomous” protection model for the determination of labor relations; lastly, require China’s corresponding supervisory authorities to strengthen the supervision of agreements provided by platforms. %K 劳动关系,劳务关系,网约工用工关系
