Research on the Safety Guarantee Obligation of E-Commerce Platform Operators %A 钱昕妍 %J E-Commerce Letters %P 3196-3202 %@ 2168-5851 %D 2024 %I Hans Publishing %R 10.12677/ecl.2024.132393 %X 关于电商平台的安全保障义务在《电子商务法》未出台之前,法院多援引《消费者安全保护法》和《侵权责任法》作为要求平台承担相应责任的法理依据,但《侵权责任法》中网络服务提供者和网络用户承担连带责任需要网络服务者知道并且未采取必要措施这两个必要前提,某些网络平台侵权案件的判决中虽然其审判结果在法理上是公正的,但如果仅仅以法条表面判断裁判结果是否合适还有待商榷。多数学者认为,在判定平台是否承担法律责任以及承担何种法律责任的考量中,应结合平台自身特点,以适用“补充责任”为原则,“连带责任”为例外,由此更好的平衡平台与消费者之间的利益关系。
Before the introduction of the E-commerce Law, the courts mostly cited the Consumer Safety Protection Law and the Tort Liability Law as the legal basis for requiring platforms to assume corresponding responsibilities. However, according to the Tort Liability Law, the network service provider and the network user should bear joint liability, which requires the network service provider to know and fail to take necessary measures. Although the trial results of some network platform infringement cases are fair in jurisprudence, whether the judgment results are appropriate only on the surface of the law remains to be discussed. Most scholars believe that in determining whether and what kind of legal liability a platform should bear, it should combine its own characteristics and apply the principle of “supplementary liability” with the exception of “joint and several liability”, so as to better balance the interest relationship between the platform and consumers. %K 电子商务法,安全保障义务,责任形态,补充责任,平台经营者
