%X 数字经济时代背景下，消费主体个人信息是企业经营主体在市场竞争中必须争取的核心资源，一定程度上可以认为对消费主体个人信息的掌握、利用程度极大影响其在市场竞争中的竞争力水平，并且随着科学技术的发展，推动数字经济蓬勃发展。但大量消费主体个人信息安全保护问题随之而来，一些企业经营主体在追求经济效益的同时，摒弃作为消费主体个人信息管理者所应当肩负的保护责任，违法违规利用或泄漏消费主体个人信息，损害消费主体合法权益。个人信息对数字经济时代所带来的巨大经济价值、绝对保护或放任滥用均不具有可采性，唯有平衡个人信息保护与利用关系，才能既促进数字经济的良好发展又能保障消费主体个人信息安全。<br />
Under the background of the digital economy era, the personal information of the consumer is the core resource that the enterprise must fight for in the market competition. To a certain extent, it can be believed that the mastery and utilization of the personal information of the consumer greatly affect the competitiveness level in the market competition, and with the development of science and technology, promote the vigorous development of the digital economy. Nonetheless, a multitude of consumer personal information security issues emerged, as some corporate entities prioritized economic gains over the protection of consumers’ personal information. The latter should bear the responsibility for their actions, as they infringe upon the legitimate rights and interests of consumers through the unauthorized use or disclosure of personal information. Personal information brings great economic value to the digital economy era, and absolute protection or abuse is not admissible. Only by balancing the relationship between personal information protection and use, can we not only promote the good development of digital economy but also ensure the security of personal information of consumers.
